§1

General conditions, website procedure, transaction service

  1. Website, available under https://www.omigrupa.pl/ (further mentioned as service provider):

  3. Service provider runs a company specializing in designing gardens and outside spaces and providing granite articles (stones, raw blocks, chunks, scraps etc.). Prices for provided services are agreed individually depending on the scope of work.
  4. Service provider holds right to refuse providing services in following situations:
    a) proposed deadline cannot be met,
    b) proposed compensation is too low considering required efforts,
    c) out of scope of provided services,
    d) any condition given by service provider.
  5. The purpose of website omigrupa.pl is contact and informational.
  6. Any communication between service provider and customer (email or handwritten correspondence, phone calls) may be recorded and archived. Disclosing any of the correspondence details is prohibited, unless consent is given by sender and recipient or in case of legal provision, on request of authorized authority.
  7. Terms and conditions for omigrupa.pl is issued based on applicable law:
    • the Act of July 18, 2002 on the provision of electronic services (Journal of Laws of 2017, item 1219);
    • the Act of May 30, 2014 on consumer rights (Journal of Laws of 2017, item 683); hereinafter referred to as PrKonsum;
    • the Act of February 4, 1994 on Copyright and Related Rights (Journal of Laws of 2017, item 880).

    - Internet Explorer version 10 or higher,
    - Opera version 12.1 or higher,
    - Firefox version 16 or higher
    - Google Chrome version 26 or higher
    - Safari version 6.1 or higher


§2

Type of services provided by service provider

Service provider runs a company specializing in designing gardens and outside spaces and providing granite articles (stones, raw blocks, chunks, scraps etc.). Prices for provided services are agreed individually depending on the scope of work.

§3

Payment conditions

  1. Compensation for agreed scope of work shall be provided via:
    a) Money transfer to specified bank account
    b) Cash payment
  2. Payment date is date when money transfer is received on the service provider account or cash is physically provided.
  3. Any details of compensation, scope of work and payment schedule is agreed individually, within the contract between the service provider and the customer.

§4

Withdrawal from the contract

  1. Pursuant to Art. 27, Art. 28 point 2) PRKonsum, the customer who is a consumer has the right to withdraw from the contract within 14 days of its conclusion.
  2. In the event of withdrawal from the contract, the customer is obliged to inform the service provider about it by submitting a declaration of withdrawal by e-mail to the following address: biuro@omigrupa.pl
  3. The declaration of withdrawal from the contract submitted after the deadline referred to in the first paragraph of this section has no legal effects. Article 61 of the Civil Code applies directly.
  4. Pursuant to Art. 38, point 1) PrKonsum, customer has no right to withdraw from the contract if service provider performed agreed services, based on the consent received from customer (who was made aware he will lose the right to withdraw from the contract).
  5. In a situation where, after the conclusion of the contract, before the expiry of 14 days to withdraw from the contract, customer submitted a declaration of withdrawal during this period, he will be obliged to pay the service provided a remuneration in the amount proportional to the degree of completion of the service by the service provider. The amount of the payment is calculated in proportion to the scope of the work provided, considering the remuneration agreed in the contract.
  6. If the customer submits a declaration of withdrawal by e-mail, the service provider shall immediately send a confirmation of receipt of the declaration of withdrawal from the contract (on a durable data carrier within the meaning of Article 2 point 4 of the PrKonsum).
  7. By concluding the contract, the customer confirms the customer has read and understood this Terms and Conditions document and is notified of his right to withdraw from the contract within 14 days from the conclusion of the contract.

§5

Final conclusions

  1. Issuing an order on omigrupa.pl is equivalent to agreement for storing and processing personal data included in the order, in accordance with the provisions of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016.
  2. Rules for personal data protection of the customer’s data are described in the Privacy Policy for Omigrupa.pl.
  3. The service provider retains his right to amend the provisions of Terms and Conditions described in this document.
